New Delhi. The Supreme Court Wednesday dismissed as infructuous a petition filed by former Jharkhand Chief Minister Babu Lal Marandi related to swearing-in of a chief minister in the state.

While dismissing the petition, an apex court bench of Chief Justice S.H. Kapadia, Justice K.S. Radhakrishnan and Justice Swatanter Kumar said: "Upon the imposition of  president's rule in Jharkhand, the matter has become infructuous."    
 

Marandi and another petitioner, Dev Ashish Bhattacharya, had the moved the court during its summer recess seeking directions to restrain Governor M.O.H. Farook  from administering the oath of office of chief minister to any person who was not a member of the state legislature.
